LIABILITY WAIVER

I have agreed to participate in Cadence Indoor Cycling Limited’s indoor cycling classes.

I acknowledge that there are risks involved in participating in this class. I am fully aware that the class, in which I agree to participate, is of a nature that is strenuous and may push me to the limits of my physical abilities. I understand that the regime is not without risks which may include, but are not reserved to the following:

  • Injury to the musculoskeletal and/or cardio respiratory system which can result in serious injury or death;

  • Injury or death due to negligence on the part of myself or other people around me;

  • Injury or death due to improper use of equipment

  • Injury or death due to a medical condition, whether known or unknown to me.

If I have an existing medical condition and/or have a condition that can be affected by flashing lights and/or loud music I will get medical permission to exercise before partaking in any class at Cadence.

I agree that I am voluntarily participating in these activities and the use of Cadence’s facilities and premises and assume all risks of injury, illness, or death.

This waiver and release of liability includes, without limitation, all injuries which may occur as a result of:

  • Use of all amenities and equipment in the facility and participation in any activity, class, program, personal training or instruction;

  • The sudden and unforeseen malfunctioning of any equipment;

  • Our instruction, training, supervision, or dietary recommendations; and

  • Your slipping and/or falling while in the building, or on the premises, including adjacent footpaths, parking areas and nearby public areas.

I acknowledge that I have carefully read this waiver and fully understand that it is a release of liability. I expressly agree to release and discharge Cadence and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action against Cadence for personal injury or property damage.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of the facility, its agents, and employees.

If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect, and only the offending provision or provisions shall be severed.

I agree that Cadence are not responsible for any loss of my personal property.

I agree to allow Cadence, its employees and volunteers to use picture(s), film and/or likenesses of me for advertising purposes. In the event I choose not to allow use of such media I must inform Cadence of this in writing.
